Is South Africa’s constitution a crime against humanity?

The only aspect of the new constitution that was entrenched in my mind in the early days of our democracy, was the fact that the New Constitution was based on the Freedom Charter.

For the purposes of taking the social and economic desires into the New Constitution, we first examine what the CODESA 1 groups brought to the ANC in the 1993 South African Constitution, that controlled the 1994 elections and the transfer of power;

Clause 26 of the Bill of Rights,

26 Economic activity

 (1) Every person shall have the right freely to engage in economic activity and to pursue a livelihood anywhere in the national territory.

(2) Subsection (1) shall not preclude measures designed to promote the protection or the improvement of the quality of life, economic growth, human development, social justice, basic conditions of employment, fair labour practices or equal opportunity for all, provided such measures are justifiable in an open and democratic society based on freedom and equality.

The 1993 Interim Constitution, provides for  the non-white persons, to have the right, to freely engage in economic activity and to pursue a livelihood anywhere in the national territory.

Importantly, this clause 26(1) shall not preclude measures designed to promote the protection or the improvement of quality of life, economic growth, and human development.

This Interim Constitution is ratified in 1993, by the Nationalist Party, handing over to the non-white population, it is symbolic of what the white economic population was prepared to accept, as we moved towards measures designed to promote the protection or the improvement of the quality of life, economic growth, human development, 

Clause 26 of the 1993 Interim Constitution symbolically symbolised the white population intention, and legally represents the promises made by the white and Afrikaner Nationalist Party to the non-white population.

The above three paragraphs, appears to be a weak attempt by the white man, to remove blame from the white man’s actions prior to 1994, it is not, but rather a challenge to the ‘struggle veterans’ and anti-Apartheid supporters, to give some Enlightened Thinking with regard to topic on the balance of this pamphlet, it may allow South Africa to move forward, or should I say, get out of the deep hole that we find ourselves in today.

Topic for Enlightened Thinking

I challenge the Nelson Mandela Foundation, the President of South Africa, President Ramaphosa, and the previous National Party MP, Mr. Roelf Meyer, to show the public of South Africa, that the changes made to the 1993 Interim Constitution, were done so in terms of the Constitutional Amendments (section74 Bills), and I quote;

4. Constitutional Amendments (Section 74 Bills)

As the highest law in the land, the Constitution is the foundation for a democratic society and protects the rights of all people. There are special requirements and procedures, therefore, in order to amend the Constitution. 

All of them require special majorities so that changes cannot be made by a minority. For example, amending the Bill of Rights requires a vote of two-thirds of the membership of the National Assembly and the support of six provinces in the NCOP.

All constitutional amendments that affect the provinces must be passed by both Houses. Amendments which affect only certain provinces, must be passed by those provinces. Other amendments do not need to be passed by the NCOP but all amendments, whether or not they must be passed by the NCOP, must be submitted to the NCOP for public debate.

In addition, minimum times are laid down for different stages of the legislative process. All constitutional amendments must be published in the Government Gazette with a call for public comment at least 30 days before being introduced in Parliament. 

After the Bill which proposes amendments to the Constitution is tabled, 30 days must pass before it can be put to a vote in the National Assembly.

Having extended the challenge on behalf of the Human Dictate movement, on behalf of every person who is excluded from the measures designed to promote the protection or the improvement of the quality of life, economic growth, human development, I submit the 1993 Interim Constitution Clause 26 Bill of Rights, and follow with the 1996/1997, New Constitution, Clause 22, of the Bill of Rights, which I submit borders on the absurd;

26 Economic activity

And then, our Celebrated Constitution,  based on the much Celebrated Freedom Charter, our Constitution has completely removed the human’s most important human right, the opportunity and space to work, the improvement of quality of life, economic growth, and human development.

I submit that such omission when transferring the Freedom Charter to the Constitution, by ignoring the provisions of the 1993 Interim Constitution, could only have been with intent, unless proof can be provided that the Constitutional Amendments (section74 Bills), had been complied with, and it was the majority of the peoples dictate, that the white capitalist monopoly should be protected.

22. Every citizen has the right to choose their trade, occupation or profession freely. The practice of a trade, occupation or profession may be regulated by law.

Clause 22 of our Bill of Rights, gives every citizen the right to choose their trade, occupation or profession freely, as desired by the non-whites from 1943 to 1993, and then negates this opportunity by using the Apartheid laws that segregated them from the economy.

The new Constitution, notwithstanding the regulation restrictions, removes the 1993 Interim Constitution, Clause 26 (1) which gives the right to freely engage in economic activity and to pursue a livelihood anywhere in the National territory, so the restriction on Clause 22 of the New Constitution Bill of Rights, only serves as a backup, incase some evil citizen tries to do the unthinkable.

 (1) Every person shall have the right freely to engage in economic activity and to pursue a livelihood anywhere in the national territory.

The State has no legal obligation to provide policies, structures and the environment, that will give every citizen the right to practice a trade, occupation or profession, in my opinion, the most important human right.

The State has no legal obligation to provide the human right, that will place the parents in the position to provide for the children’s well-being, their education, the development of the economy, and the accumulation of wealth.

To my friends who support and defend their minority rights thanks to our Constitution, give a thought to the masses, who are not exposed to the odd humiliation, but through the lack of opportunity and space to provide for the family, face humiliation daily, our Constitution that protects your minority rights, provides for the masses further oppression.

I repeat;

My Human Dictate philosophy reflects on the establishment of the Global Market, as WWII draws to an end, the Latipac, the owners of the Global Market, entrenches the Age of Anonymity, where the very complex shareholding, becomes hidden, almost impossible to see.

This same process, hides who manipulated Africa and South Africa’s self-determination process, that leaves the subjugated, in the same state that they were in 1940, even though they have the vote, that should have changed their lives.

I am of the opinion that South Africa’s history has been created to appease those subjugated peoples, giving them the belief that they had achieved Freedom, when all they have achieved is the vote, that will never allow change for their position.

My ‘spiritual guidance’, research shows that the Latipac, influenced by the mining sector, have manipulated South Africa’s politics.

I repeat, had the mining industry, used only South African labour in their total labour force, and paid them maybe 60% of their ‘own labour value’, South Africa as a nation, would be wealthier today, both black and white, and the country would be wealthier, but the Rand Lords and the mining investors, would not have extracted the wealth that they did from us?

There is little doubt in my mind, that the restriction on the movement of black people was to hide, the use of the cheap slave labour used in the mines for 150 years. Imagine the chaos if my black brothers could move freely in large numbers, and discover that the mine labour was mainly foreign nationals.

During 1946, the gold mining industry, is effected by the labour trikes, that attracts Nelson Mandela, to the Africanist Nationalist philosophy, I quote an extract from Long Walk to Freedom.

IN 1946, a number of critical events occurred that shaped my political development and the direction of the struggle. The mineworkers’ strike of 1946, in which 70,000 African miners along the Reef went on strike, affected me greatly. At the initiative of J. B. Marks, Dan Tloome, Gaur Radebe, and a number of ANC labor activists, the African Mine Workers Union (AMWU) had been created in the early 1940s. There were as many as 400,000 African miners working on the Reef, most of them making no more than two shillings a day. The union leadership had repeatedly pressed the Chamber of Mines for a minimum wage of ten shillings a day, as well as family housing and two weeks’ paid leave. The chamber ignored the union’s demands.
In one of the largest such actions in South African history, the miners went on strike for a week and maintained their solidarity. The state’s retaliation was ruthless. The leaders were arrested, the compounds surrounded by police, and the AMWU offices ransacked. A march was brutally repulsed by police; twelve miners died. The Natives Representative Council adjourned in protest. I had a number of relations who were mineworkers, and during the week of the strike I visited them, discussed the issues, and expressed my support.

Closer scrutiny of historical charts, reflects that the South African contingent in 1946, was, according to the charts, only about 70 000 workers, with the total labour force, close to 350 000. I am of the opinion that the only workers on strike were the South African contingent.

From the 1946 mine strike, the labour contingent continues to drop, and if I was an investor in the mining industry, I would have been manipulating the countries politics towards control by the ‘aggressive’ Afrikaner, in order to ensure that the protection of my wealth, the wealth protection would be ensured, and I believe, that Latipac, mainly involved in the mining industry, would have manipulated the 1948 general election, and brought the NP into power, as the South African labour contingent reaches the bottom participants of the employment stakes.At the risk of upsetting my Afrikaner brothers, let me suggest that the English Coloniser, the mining industry, that the Africanist Nationalism was a great threat to their profits, as an investor in he mines, I would have wished to have the Afrikaner in control of the protection of my wealth, every Afrikaner, male and female, from 6 years-old to 90 years-old, could handle a side-arm, a rifle, a shot-gun, ride motor-bikes, drive cars, tractors, trucks, they proved their abilities during the Anglo-Boer-War, it was now time to use them.Between 1950 to 1955, the English Coloniser influenced the selection of the ANC, as the less radical party, and the black group that would be entrusted to lead the country, when the need arises.

In 1994, we experience the eventual transfer of political power, to the ANC, in Pamphlet 13, I sort of criticise Nelson Mandela, President Ramaphosa, Mr. Roelf Meyer, for how Clause 26, of the 1993 Interim Constitution, is manipulated to protect the White Capitalist Monopoly, by Clause 22, of the 1996 Constitution of South Africa, and I repeat the clause;

I again ask the question, would these gentlemen, collectively have colluded to restrict the practice of a trade, occupation or profession, to be regulated by Apartheid laws and Heritage?

Or, did the typically reply on a Consultant to do the final draft?

Is it possible that the Latipac’s wealth controls the Economic and Political Democracies of the World, when their voices are hardly heard, their faces are hardly seen, can an anonymous structure, an anonymous system, influence both the Apartheid Government, and the ANC Government?

I am of the opinion that this group, I do not consider the participants to be ‘white’, have infiltrated the Government Structures, as part of the “Consultant Brigade’, serving the Monarchy, the Presidents, the Prime Ministers, the Ministers, the Deputy Ministers, the leaders of the opposition.

These Producers and Directors, influence South Africa’s every political move, and they should be added to the ‘credits list’, as the South African Parliament Sessions, give the world laughs, at our human’s expense.
